Consumer Early Access Terms (DRAFT)
Version: early-access-2026-10-v2-draft
IMPORTANT: This is a working draft flagged for counsel. It has not been reviewed or approved by a lawyer. Do not treat it as final or binding until 3rdSpace publishes a counsel reviewed version.
These terms cover one thing: joining the waitlist for the 3rdSpace consumer app, and getting early access to that app if you are in the first 10,000. They are short because what you are agreeing to is small.
Plain language summary
Read this first. The numbered sections after it are the full terms, and they control if anything here is unclear.
- The app does not exist yet. 3rdSpace is building a discovery app. It is not released, there is no release date, and we are not promising one.
- We are not promising the app will ever launch. We intend to build it. If we do not, being on the waitlist gets you nothing, and that is the honest position rather than a hidden one.
- The first 10,000 confirmed phone numbers get early access. Your spot is reserved when you confirm your phone number, not when you sign up. Past 10,000 you are still on the list, just not in the early access group.
- One spot per phone number, and one per account. A spot is yours personally. It cannot be sold, traded, or transferred.
- You can leave whenever you want, and your spot goes to the next person. Leaving the waitlist is not the same as asking us to delete your data; section 8 says what each one does.
- Early access means unfinished software. Expect bugs, missing features, and downtime. Data you put into it may be lost.
- Joining is free and stays free. There is no charge to join the waitlist and no charge for a spot. We will never ask you to pay for one.
- Joining asks you to tick nothing. The waitlist page has no boxes. Updates about the app follow the email and text choices you made when you created your account, and you can stop either at any time.
- These terms will change, and the app's terms when it launches will be their own thing.
- Your 3rdSpace account is already covered by the Terms of Service, the Privacy Policy, and the Acceptable Use Policy, which you accepted when you created it. Sections 1 to 5, 7, 8 and 9 of these terms (the waitlist) form part of the Terms of Service and apply when you join. Section 6 (early access) and the rest apply when you accept them, which we will ask you to do when early access begins.
1. What you are joining
The 3rdSpace consumer app is a discovery app: a way to find places and things happening near you. It is in development and it has not been released. There is no public version, no beta version you can install, and no release date.
The waitlist is a list of people who want to be told when it is ready and who want to be among the first to use it. Joining it does not give you the app, access to any software, or any account beyond the free 3rdSpace account you already have.
2. What we are promising, and what we are not
We are promising this much. If we release the consumer app, we intend to give early access to the first 10,000 people who hold a waitlist spot, before opening it more widely.
We are not promising any of the following, and you should not join on the assumption of them:
- That the app will be released at all.
- Any date, month, season, or year for a release.
- Any particular feature, or that features described anywhere else will exist in the released app.
- That early access will last any particular length of time, or that it will not be changed, paused, or ended.
- That the app will be free after early access, or that any price described later will apply to you.
If we decide not to build or release the consumer app, we will say so rather than leave the waitlist running.
3. How a spot works
Your spot is reserved when your phone number is confirmed, not when you create an account and not when you press Join. If you join first and confirm your number later, the spot is assigned at the moment the number is confirmed. This is how the ordering stays honest.
One spot per phone number. A confirmed phone number can hold exactly one spot, across all accounts. If your number already holds a spot under a different account, you cannot take a second one.
One spot per account. An account holds at most one spot.
US phone numbers only, at launch. The waitlist is open to US numbers because that is where the service runs today.
Past 10,000. If the first 10,000 spots are taken by the time your number is confirmed, you still get a position on the list. You are not in the early access group, and the page tells you so plainly rather than leaving you to assume otherwise.
A spot is personal to you. It is not property, it has no cash value, and it cannot be sold, auctioned, traded, gifted, or transferred to anyone else. We may remove a spot obtained by selling or buying one.
4. Leaving, and what happens to your spot
You can leave the waitlist at any time from the waitlist page. When you do, your spot is released and goes to the next person who qualifies. Your 3rdSpace account is not affected and nothing else about it changes.
If you leave and come back, you do not get your old number back. You rejoin at the end of the line, using the same phone number.
Leaving the waitlist is not a deletion request. See section 8.
5. When we can remove a spot
We may remove your spot, and where appropriate suspend the account behind it, if:
- the phone number turns out not to be yours, or not to be a working US number;
- the spot was created by automated means, by evading the sign up checks, or through multiple accounts intended to take more than one spot;
- the spot was bought, sold, or transferred; or
- your use of 3rdSpace breaches the Terms of Service or the Acceptable Use Policy.
Where we can, we will tell you before or when we do this, and you can reply and ask us to look again.
6. Early access means unfinished software
If you receive early access, what you get is pre release software. That means:
- Bugs, errors, missing features, and downtime are expected, not exceptional.
- Data may be lost. Anything you save in an early access build should be something you can afford to lose.
- It will change without notice, and features may be added, changed, or removed.
- It is provided as is, to the fullest extent the law allows. The warranty and liability terms in the Terms of Service apply, including any limits on our liability and any rights you have under consumer protection law that cannot be waived.
- We may end or pause early access at any time, for everyone or for you individually.
7. What it costs
Joining the waitlist is free. Holding a spot is free. Early access itself carries no charge, and we will not ask you to pay for a place in line or a better position in it.
Standard message and data rates from your mobile carrier may apply to the text message we send to confirm your number, and to any launch updates you ask for under section 9.
Nothing here promises the released app will be free. If any part of it is ever paid, we will say so before you are charged, and you will never be charged automatically because of anything in these terms.
8. Your information, leaving, and deletion
Our Privacy Policy governs what we collect and why, and Section 6C of it covers the waitlist specifically: your account details, your confirmed phone number, a record that you accepted these terms (with the date and the IP address the acceptance came from), and your position.
Three different things are often confused, so here is each one plainly.
Leaving the waitlist. Removes your spot and frees it for the next person, and clears the flag that says you want the consumer app. It does not delete your 3rdSpace account and it does not delete anything else. You do this yourself from the waitlist page.
Deleting your 3rdSpace account and the personal information we control. This is a separate request, and you make it on our deletion request page. You do not need to be signed in, and you confirm your email address or phone number so that nobody can have someone else's information deleted.
What happens straight away. From the moment you confirm, three things take effect: nothing we operate will text or email you again, your details cannot be added back to any list here, and any record that matches is taken out of use and protected, so it cannot quietly age out while your request is open.
What we can honestly tell you about the rest. Our deletion process reaches your waitlist entry and releases your phone number. It does not yet automatically reach the account record itself, which holds your email address, name, phone number, and your consent history including the IP addresses. Completing a deletion beyond the waitlist entry currently requires manual work by us, and part of the automated process is switched off pending a legal review. We say this because it is true, not because we think it is acceptable. We will do it by hand, and Privacy Policy Section 21 states the right you have regardless of how far our tooling has got, with the timeframes we hold ourselves to.
A host's own records are separate. If a venue or business on 3rdSpace holds a record about you as their customer, that is their record and deleting your 3rdSpace account does not automatically remove it. Privacy Policy Section 25 covers this.
9. Messages we send you
There are two different kinds and they work differently.
The confirmation code. To confirm your number we send you one text message with a code. That message is part of signing up rather than marketing, and you cannot opt out of it and still hold a spot, because the confirmed number is what the spot is built on. We may also send you service messages about your account, such as a security notice. Those are not marketing either.
Launch updates. You may want to hear about the 3rdSpace app: when it is ready, when early access opens, and where your spot stands. The waitlist page has no boxes for this. We send these updates only as the marketing choices you made when you created your account allow: by email if you left the email box selected, and by text only if you ticked the text box yourself. Neither is required to join, and neither affects your place in line or your early access.
What the text choice means. If you ticked it, you agreed that 3rdSpace may send you marketing text messages, including messages sent by automated means, at the mobile number on your account. 3rdSpace is the sender of these, not a venue or any other business. We expect to send a few messages a month at most, and fewer than that while the app is still being built.
Standard message and data rates from your mobile carrier may apply.
How to stop them, and it works whether or not you can reach a settings page:
- Text: reply STOP to any of our texts. Reply HELP for help.
- Email: use the unsubscribe link at the bottom of any marketing email.
- Either, or both: email support@3rdsp.co and say so.
- Everything, permanently: our deletion request page is a different and larger thing. Stopping messages leaves your spot and your account alone; deletion does not.
Stopping marketing messages does not remove you from the waitlist, and it does not stop the confirmation code or a service message about your account.
Where you change this. On 3rdsp.co, your Me page lets you turn marketing emails on or off and turn marketing texts off. The three routes above always work, wherever you are, and each is recorded on our own records rather than only at the company that delivers the message.
If you stop the texts and later want them back, reply START. If we still hold your earlier agreement to receive them, we turn them back on and note that you asked. If we do not, we note that you asked and send nothing until you agree again. Replying START never changes anything about email.
Joining the waitlist by itself does not sign you up for marketing, and changes nothing about what we send you.
10. Changes to these terms
We will change these terms as the product develops. When we do, we update the version identifier at the top of this document. If a change materially reduces what you get, we will tell you before it takes effect. A change to the waitlist sections applies as a change to the Terms of Service does (their Article 4); a change to the early access sections after you accepted them is offered to you to accept again.
When the app launches it will have its own terms, which you will be asked to accept then. These terms do not pre-commit you to those.
11. Where this fits
These terms are in addition to the 3rdSpace Terms of Service, Privacy Policy, and Acceptable Use Policy, which continue to apply in full. Those documents govern your 3rdSpace account, your rights, dispute resolution, and governing law. If these terms and the Terms of Service conflict on a point specific to the waitlist or to early access, these terms control for that point. On everything else, the Terms of Service control.
